General Terms and Conditions of Consignment Sale

1. Subject matter of the contract

This document defines the conditions under which CHAKMAR Luxe accepts luxury items (bags, leather goods, accessories) on consignment, with the aim of offering them for sale via its online platforms and partner networks.


2. Selection of articles

CHAKMAR Luxe reserves the right to:

  • Refuse any item that does not meet its criteria of quality, authenticity or brand image.
  • Request documents of authenticity (invoice, authenticity card, serial number, certificate, etc.).
  • Refuse items that are damaged, counterfeit, or of questionable origin.

3. Applicant's commitment

  • The depositor declares that he or she is  the legal owner of the deposited items.
  • He undertakes not to offer the same items for sale on another platform for the entire duration of the deposit (exclusive mandate).
  • He keeps the item at home until the sale, unless specifically agreed.

4. Duration of the deposit

  • The deposit is concluded for a period of 90 days, which is automatically renewable in periods of 30 days.
  • After this period, the depositor may take back his article at any time, upon simple written request.
  • In the event of early withdrawal of the item within the first 30 days, a lump sum compensation of 10% of the original sale price is due.

5. Sale price

  • The sale price is set by mutual agreement between CHAKMAR Luxe and the depositor.
  • CHAKMAR Luxe reserves the right to adjust this price (maximum 10% reduction) after 60 days to optimize the chances of sale, unless the depositor objects in writing.

6. Commissions on the sale

CHAKMAR Luxe applies a commission of between 10% and 25% of the sale price including VAT, depending on the brand, the value of the bag, its condition, its rarity and the necessary marketing strategy.

The exact commission rate is determined by mutual agreement between CHAKMAR Luxe and the depositor upon validation of the deposit. It is specified in the  signed deposit slip.

This commission covers:

  • product enhancement (photos, detailed description),
  • dissemination on our partner platforms,
  • buyer management,
  • and, where applicable, verification or authentication actions.

No commission is due if the bag is not sold.


7. Payment to the Depositor

  • Payment is made within 10 working days of the final sale (customer withdrawal period has elapsed).
  • Payment is made by bank transfer or check, depending on the information provided

8. Liability & Insurance

  • Items remain in the custody of the depositor until sale unless a request is made for temporary physical deposit.
  • CHAKMAR Luxe declines all responsibility in case of loss, theft or damage as long as the item is kept at the depositor's premises.
  • In the event of physical deposit, the items are insured against theft, fire and damage.

9. Removal of unsold items

  • In the event of unsold items at the end of the contract, CHAKMAR Luxe will contact the depositor to:
    • Either return the item (if physical deposit),
    • Or extend the sales mandate with price adjustment.
  • If there is no response within 30 days, the item may be donated, recycled or sold for the benefit of the company (outside of the contract).

10. Disputes

Any dispute relating to the interpretation or performance of this contract shall be subject to the exclusive jurisdiction of the courts of CHAKMAR Luxe's registered office.


11. Acceptance

The deposit of an article implies full and complete acceptance of these conditions.
