This document governs (i) returns and withdrawal, (ii) returns for non-conformity/warranty, and (iii) delivery terms (Belgium/EU/international, customs). It is designed for luxury and second-hand items where integrity, traceability, and resale value are essential. Mandatory consumer rights remain applicable.
1. Scope and definitions
These conditions apply to any distance purchase made via www.chakmarluxe.be between CHAKMAR Luxe (the “Seller”) and any buyer (the “Customer”). When the Customer acts for non-professional purposes, they are a “Consumer”. Certain provisions (e.g., the right of withdrawal) apply only to Consumers.
- Product: item sold (new or second-hand) or accessory.
- Integrity / Traceability: all elements supporting authenticity and resale (box, dustbag, protections, accessories, tags, numbers, documents).
- Reasonable inspection: handling strictly necessary to assess nature, characteristics, and functioning (no real use, no extended outdoor wear, no removal/alteration affecting resale).
- RMA: return authorization (case reference) required before any return shipment.
2. General rule: no return without prior request (mandatory RMA)
All returns require a mandatory prior request. Any parcel returned without an RMA, without a reference, or sent to a non-approved address may be refused or processed with delay (notably for security and traceability reasons).
3. Right of withdrawal (Consumers – distance sales)
Unless a legal exception applies, the Consumer has 14 calendar days from the day they receive the Product to notify their decision to withdraw. The notice must be clear (e-mail or letter) and allow the order to be identified.
Important – Luxury products: the right of withdrawal does not authorize use of the Product. The Customer is liable for any diminution in value resulting from handling beyond reasonable inspection. If resale “as received” becomes impossible (odours, marks, broken seals, missing accessories, removed protections, etc.), a depreciation deduction up to 100% may apply.
4. Exceptions and exclusions (according to the law)
In accordance with applicable legislation, the right of withdrawal may be excluded or limited in certain cases provided by law, including personalised goods, products made to the customer’s specifications, services fully performed with the customer’s prior consent, certain digital content, as well as sealed goods which are not suitable for return due to health protection or hygiene reasons once they have been unsealed after delivery.
For strict reasons of hygiene, health protection and customer safety, no return, exchange or refund will be accepted for intimate items or similar products when their packaging, seal, protective label, hygiene strip, protective film, inner protection or original packaging has been opened, removed, altered or damaged after delivery.
This includes, without limitation:
- underwear of any kind;
- lingerie;
- bras, bralettes, bustiers, corsets, bandeaus, lingerie tops, adhesive cups, pads, nipple covers and similar items;
- briefs, thongs, tangas, shorties, boxers, slips and underpants;
- bodysuits, nightwear and items considered equivalent to lingerie;
- tights, stockings, fine socks and items in direct contact with the skin;
- swimwear, bikinis and bathing items where the hygienic protection has been removed, moved, altered or damaged;
- any intimate item, textile product or accessory that cannot be resold for hygiene or health protection reasons.
Specific case of bras and similar items
Particular attention is given to bras, bralettes, bustiers, corsets, bandeaus, lingerie tops, adhesive cups, pads, nipple covers and similar items, due to their direct or potential contact with the chest, skin, underarms and areas exposed to perspiration, creams, perfume, deodorant, make-up or other body and cosmetic products.
For strict reasons of hygiene and health protection, these items may only be returned if they are in strictly new condition, unworn, unwashed, unused, undeformed, unstained, odour-free and without any trace of perspiration, deodorant, cream, perfume, make-up or any other body or cosmetic product.
Any bra, bralette or similar item that has been tried directly on the skin, worn even briefly, washed, perfumed, stained, marked, deformed or showing any sign of use will be refused for return.
Bras, bralettes and similar items delivered with sealed packaging, inner protection, a security label, protective film, hygiene strip or any other protective device cannot be returned if such protection has been opened, removed, displaced, altered or damaged after delivery.
Strict fitting conditions
Any fitting of an item must be carried out with the greatest care, only in clean conditions, without direct contact with intimate body areas, without removing hygienic protections, without removing labels, without washing, without perfume, without deodorant, without make-up marks, without odour, without stains and without any alteration to the product or its packaging.
For intimate items or similar products, any fitting involving direct contact with the skin or intimate body areas, any removal or displacement of the hygiene strip, any removal of the protective film, any unsealing of the packaging or any alteration of the original packaging will make the item non-returnable.
A returned item must show no signs of use, prolonged fitting, actual wear, washing, excessive handling or deterioration. CHAKMAR Luxe reserves the right to refuse any return where the condition of the product no longer allows it to be resold under normal, safe and hygienic conditions.
These items must be returned new, unworn, unwashed, unused, complete, in their intact original packaging, with all labels, protections, films, hygiene strips and seals in place. Failing this, CHAKMAR Luxe reserves the right to refuse the return or, where permitted by law, to apply a deduction corresponding to the loss in value of the product.
If an exception to the right of withdrawal applies to a product or service, CHAKMAR Luxe informs the customer before purchase where required by law. Refusal of a return for hygiene reasons does not affect the consumer’s statutory rights in the event of a proven lack of conformity or defective product.
5. Return procedure (mandatory) – steps and evidence
- Mandatory prior request by e-mail to info@chakmarluxe.be including: order number, name, item(s), reason, and photos (outside/inside, accessories, packaging, any tags/seals, alleged defect).
- Receive the return instructions (return address, RMA, packing instructions, recommended carrier). No shipment should be made before receiving these instructions.
- Ship with tracking. For high-value items, an appropriate insurance is strongly recommended.
- Keep proof of shipment. Return shipping risk remains with the Customer until the parcel is effectively received by CHAKMAR Luxe.
Practical advice (evidence)
To avoid disputes, we recommend filming the unboxing upon receipt and keeping the original packaging. For returns, we also recommend filming the packing process (Product + accessories + protections + closing the parcel).
6. Integrity requirements (luxury) – cumulative conditions
To be eligible, the return must meet all conditions below. Failing this, the return may result in a depreciation deduction or, in certain cases, a refusal.
- Unused Product: careful inspection/try-on indoors only (no real use, no outdoor wear).
- Complete Product: box, dustbag, protections, films, foam, papers, documents, certificates, accessories, packaging, etc.
- No odour / no marks: perfume, smoke, cooking, humidity, make-up, cream, colour transfer, dust, pet hair, etc.
- No intervention: cleaning, polishing, recolouring, repairs, gluing, adjustments, parts replacement, added accessories.
- Tags/seals/numbers (if any): intact, not removed, not cut. A broken seal may render the Product unsellable.
7. “Unpacked” items and resale impact
In luxury resale, opening and handling may reduce resale value. The Customer acknowledges that certain elements (films, protections, seals, tags, tissue paper, packaging, micro-scratches, deformation, odours) may make the Product unsellable “as new” or inconsistent with resale standards.
Therefore, if handling goes beyond reasonable inspection, CHAKMAR Luxe may apply a proportionate depreciation reflecting the loss of value and the required costs (inspection, reconditioning, specialized cleaning, re-certification, etc.). This depreciation may reach 100% when resale in the returned condition is impossible or when security/traceability is compromised.
8. Receiving inspection – security, authenticity, anti-substitution
Upon receipt, CHAKMAR Luxe performs an in-depth inspection: completeness, condition, conformity, reference matching, number/tag consistency, signs of use, odours, and anti-substitution checks.
In case of suspected substitution, forgery, or fraud (different Product, replaced parts, altered number, missing critical accessory), CHAKMAR Luxe may refuse the return, document the situation (photos/videos), keep evidence as needed and, if appropriate, cooperate with competent authorities. Mandatory rights remain applicable, but the Customer bears the consequences of their actions.
9. Returns for non-conformity, defects and warranty
Independently of withdrawal, the Customer may benefit from applicable statutory warranties (depending on the Customer’s status, the Product, and the law in force). Any claim must be sent to info@chakmarluxe.be with a clear description, evidence, and photos.
- Damage caused by improper use, poor storage, or unauthorized intervention is not covered.
- For second-hand items, the Customer acknowledges possible signs of wear disclosed on the product page.
- If a return is justified, CHAKMAR Luxe will provide the RMA procedure and handling terms as required by law.
10. Packaging and return shipping
The Customer must protect the Product against shocks, moisture, and pressure. Insufficient packaging causing damage may be charged to the Customer. For luxury items, CHAKMAR Luxe recommends: double boxing (original box protected inside a sturdy outer carton), padding, and appropriate insurance.
11. Delivery terms (Belgium / EU / International)
11.1 Address accuracy and accessibility
The Customer is responsible for accurate delivery information (name, address, postcode, phone, e-mail, instructions). Any mistake, absence, or access issue (door code, floor, pick-up point) may cause delays, return to sender, and additional costs charged to the Customer.
11.2 Indicative timeframes
Displayed timeframes are indicative unless otherwise agreed in writing. They may vary depending on the carrier, peak periods, destination, or security checks. A reasonable delay does not automatically grant cancellation/compensation, subject to mandatory rights.
11.3 Transfer of risk
For Consumers, risk transfers when the Customer (or a designated third party) physically takes possession of the parcel. For business Customers, risk may transfer upon handover to the carrier, in accordance with applicable law and the CGV.
11.4 Receipt check – transport damage
The Customer must check the parcel upon delivery. If any anomaly is found (opened parcel, damage, broken seal), the Customer must:
- make clear reservations with the carrier where possible,
- take immediate photos (parcel, label, protections, Product),
- contact CHAKMAR Luxe as soon as possible (ideally within 48h) with evidence.
11.5 Customs, duties and import (outside the EU)
For deliveries outside the EU, customs duties, taxes, import or clearance fees may be charged by local authorities. Unless stated otherwise, these costs are borne by the Customer. Customs formalities may extend timeframes. Refusal to pay duties/taxes or refusal of delivery may result in return-to-sender and costs charged to the Customer.
11.6 Security measures (anti-fraud / order consistency)
To secure transactions (especially for high-value items), CHAKMAR Luxe may perform reasonable checks (order/address/payment consistency, confirmation request, etc.) in compliance with applicable law. The Customer accepts these measures intended to prevent fraud.
11.7 Force majeure
CHAKMAR Luxe cannot be held liable for delay or failure caused by an unforeseeable external event (strike, severe weather, customs blockage, carrier disruption, widespread outage, etc.). Mandatory legal obligations remain applicable.
12. Luxury return checklist – strict requirements
- Reasonable inspection only (no outdoor use)
- Complete: box + dustbag + protections + accessories + documents
- No odour, no marks, no intervention
- Packaging: protected box + outer carton + padding
- Shipping: tracking + recommended insurance
- Mandatory RMA: prior request by e-mail + case reference
